{"id":1463,"date":"2009-07-10T10:58:28","date_gmt":"2009-07-10T15:58:28","guid":{"rendered":"http:\/\/www.thinkinghousewife.com\/wp\/?p=1463"},"modified":"2009-07-10T11:03:14","modified_gmt":"2009-07-10T16:03:14","slug":"same-sex-marriage-suit","status":"publish","type":"post","link":"https:\/\/www.thinkinghousewife.com\/2009\/07\/same-sex-marriage-suit\/","title":{"rendered":"Same-Sex Marriage Suit"},"content":{"rendered":"<p class=\"first\">\u00a0<\/p>\n<p>The need for a federal constitutional amendment defending traditional marriage became more apparent yesterday when\u00a0Massachusetts became the first state to seek\u00a0a judicial repeal\u00a0of the\u00a0Defense of Marriage Act.<\/p>\n<p>In its <a href=\"http:\/\/news.yahoo.com\/s\/ap\/20090709\/ap_on_re_us\/us_gay_marriage\">suit<\/a>\u00a0against the U.S. Government filed in federal court in Boston,\u00a0Massachusetts claims\u00a0the Defense of Marriage Act (DOMA) denies &#8220;equal treatment under the law&#8221; to the 16,000 homosexual couples who have married in the state.\u00a0The federal law, enacted in 1996,\u00a0gives states the authority to refuse to recognize same-sex marriages performed in other states. Massachusetts legalized same-sex marriage in 2004, but homosexual couples married there cannot have their marriages recognized in most other states.<\/p>\n<p>The argument on which the suit is based is spurious. There is no denial of civil rights to homosexuals under traditional marriage laws. Anyone &#8211; homosexual or heterosexual &#8211; is permitted to marry a person of the opposite sex. Anyone &#8211; homosexual or heterosexual &#8211; is permitted to have a spouse of the opposite sex receive federal marital benefits such as Medicaid.\u00a0Traditional marriage laws and regulations\u00a0are equally applied to all adults. Homosexuals are entitled to marry everywhere in America.<\/p>\n<p>It is not possible for states with dramatically opposed definitions of marriage to amicably coexist.\u00a0State laws govern\u00a0millions of child custody decisions made\u00a0every year.
