Obama once said something to the effect that the U. S. Constitution says a lot about what we can’t do, but that it does not tell us what we can do; that that is too negative. We need the clarity of unambiguous positive affirmation.
California wants to finally set the standard for “yes”, which would exclude all else as “no”. The issue of consent, given or revoked, will soon be settled.
